AGB PEth in Mind Conference


Scope

The following general terms and conditions regulate the contractual relationship between the participants in seminars, courses and conferences (hereinafter “Event”) and the Society of PEth Research (hereinafter “PEth-NET”). Deviating general terms and conditions of the participants are not valid.

Section I of these terms and conditions contains our general provisions that apply to all of our services.

1. Registration / confirmation of registration

You can register on our event page or on our general website. If you register via our event page or our website, you will first receive a confirmation of receipt. The contract is then concluded either with a confirmation from PEth-NET (only by e-mail) or with the debiting of the participant’s fee.

2. Performance

Our services include the components described in the event overview.

3. Disruptions in performance, cancellation

We will do everything in our power to provide the services we have promised as shown in the event documents. However, PEth-NET reserves the right to make necessary changes to the event program while preserving the overall character of the event, in particular to replace announced speakers with others and to change the event location, provided this is reasonable for the participants.

If the event cannot be held due to insufficient number of participants, the participants will be informed immediately. The cancellation due to insufficient number of participants will be made no later than two weeks before the event. The event fee will be reimbursed in these cases.

If the obstacle lies in the prevention of a speaker or disturbances at the event location as well as in cases of “force majeure” (these are cases such as war, revolutions, strikes, natural disasters or pandemics that are beyond our sphere of influence), we can change the event to an appropriate new date, whereby an alternative date within the next 16 weeks is considered appropriate. If an event cannot be held within a reasonable period of time or if the “force majeure” lasts longer than four months, we will cancel the event and you will receive the event fee back, if paid. A claim for reimbursement of travel and accommodation costs as well as loss of work is excluded, unless such costs arise due to grossly negligent or willful behavior on the part of PEth-NET. PEth-NET undertakes to do everything reasonable in the event of any service disruptions in order to contribute to the elimination or limitation of the disruption. Claims for reimbursement by a participant due to merely temporary disruptions to an event are excluded.

If one of the participants cancels up to ten weeks before the event, PEth-NET will charge 50% of the registration fee as a cancellation fee. After this date or in the event of a no-show, 100% of the registration fee will be charged. PEth-NET is happy to accept a substitute participant at no additional cost. Furthermore, the participants have the option to prove that the damage did not occur at all or was significantly lower than claimed by PEth-NET.

4. Due date and payment, default, offsetting

The participation fee is per person and event date. It includes conference documents as well as lunch and beverages during breaks. The participation fee is due 14 days after invoicing. If the participant is in default of payment, PEth-NET is entitled to charge interest on arrears in the amount of 5% p.a. to be requested. If PEth-NET proves a higher damage caused by default, this can be asserted. In the same way, the participant is entitled to provide evidence that the damage did not occur at all or was significantly lower than claimed by PEth-NET.

Payment is made at the choice of the participant (s): in via the payment methods offered by PEth-NET. PEth-NET reserves the right to exclude certain payment methods in individual cases. Payment by sending cash or checks is not possible; PEth-NET assumes no liability in the event of loss. The participant can only offset claims that have been legally established or recognized in writing by PEth-NET. The participant is only authorized to exercise a right of retention if his counterclaim is based on the same contractual relationship.

5. Copyrights

All conference documents for our events are protected by copyright. Participants are only granted a simple, non-transferable right of use for personal use. In particular, participants and third parties are not permitted to change the content or editorial content of the conference documents – even in extracts – or to use modified versions, to copy them for third parties, to make them publicly available or forward them, to post them on the Internet or in other networks for a fee or free of charge to imitate, resell or use them for commercial purposes. Any copyright notices, marks or trademarks may not be removed. All of the aforementioned provisions of this Section also apply to the video and audio recording of the event itself; these are only permitted with our prior consent.

6. Liability

The events are carefully prepared and carried out by qualified speakers. PEth-NET assumes no liability for the topicality, correctness and completeness of the event content, the conference documents and the usability of the event for professional or personal purposes of a participant.

In addition, our liability in cases of slight negligence is limited to the breach of essential contractual obligations (“essential contractual obligations” are those that are necessary to fulfill the contractually promised services and on the fulfillment of which the parties can therefore regularly rely); liability in these cases is limited to typical foreseeable damage.

7. Hygiene concept

The hygiene concept of PEth-NET is part of these general terms and conditions and is adapted to the prevailing situation (e.g. COVID-19) and dependent on the rules of the venue.

8. Applicable law, place of jurisdiction and place of performance

Swiss law applies. PEth NET acts as an association, individuals are not liable. The place of jurisdiction is Bern, Switzerland.

9. Right of withdrawal for consumers

You have the right to cancel this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day the contract is concluded (this is the day on which the confirmation of registration is received) or fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the last goods has.

In order to exercise your right of withdrawal, you must write to us using the PEth-NET contact form.

Consequences of the withdrawal

If you withdraw from this contract, we will have given you all payments that we have received from you, to be repaid immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment, we will use the same means of payment that you used in the original transaction unless it was with you something else expressly agreed. Transaction fees may occur due to exchange rates and exchange rate fluctuations. PEth-NET does business in Swiss Francs.
